1. Introduction
These Terms of Use ("Terms") govern your access to and use of tackandjibe.com (the "Website"). By using the Website, you agree to be bound by these Terms.
Tack & Jibe Ltd is a UK-based company operating an online boat marketplace.
2. Use of the Website
The Website permits users to register, list boats for sale, view available listings, and reach out to vendors.
3. User Responsibilities (Marketplace)
Users must ensure boat listings are truthful, current, and not deceptive, complying with UK regulations. Users may only advertise boats they possess legitimate authority to sell without breaching third-party intellectual property.
We do not participate in boat sale transactions and are not liable for any disputes arising from transactions between buyers and sellers.
4. Product Purchases and Payments (E-commerce Shop)
Orders remain conditional on stock availability, with the company retaining cancellation rights for unavailable items or pricing errors. Product pricing displays in GBP and encompasses applicable taxes, though shipping charges calculate separately at checkout.
Payments process via secure third-party providers, whose terms users must accept. The company reserves authority to reject orders based on suspected fraudulent activity or other concerns.
Broker subscriptions and listing capacity
Broker plans include a maximum number of active listings. After a successful complete feed import crosses the warning level, we will notify the brokerage. If the active count exceeds the plan allowance, all listings remain live during a seven-day grace period. The brokerage can upgrade immediately or archive listings to return within its allowance.
Where the brokerage has explicitly enabled automatic capacity upgrades, remaining over capacity at the end of the grace period authorises Tack & Jibe to move the subscription to the smallest tier that accommodates the active listing count. Monthly subscriptions remain monthly and annual subscriptions remain annual. The renewal date is retained and Stripe charges the prorated difference for the remainder of the current billing period. Removing listings later does not create an immediate downgrade or refund; a lower tier may be selected for the next renewal.
If automatic upgrades are not enabled, or an upgrade payment remains unresolved after the payment-recovery period, the newest excess feed listings may be made inactive. They are not marked as sold. This preference can be changed in Broker Billing before the grace deadline.
5. Shipping and Delivery
Products ship exclusively within the United Kingdom, with delivery costs and timeframes shown before purchase completion. Delivery dates provided are estimates only and not guaranteed. The company assumes no responsibility for courier delays or unforeseeable circumstances. Risk transfers to the customer upon product delivery.
6. Returns and Refunds
Return and refund procedures follow a separate Returns Policy document available on the Website.
7. Limitation of Liability
The platform offers no warranties regarding accuracy or completeness of displayed information. Our total liability to you shall not exceed the total amount paid by you for products or services provided through our platforms.
The company excludes liability for indirect, incidental, special, or consequential damages from platform use.
8. Intellectual Property
All Website materials — including logos, text, graphics, and images — remain exclusive Tack & Jibe Ltd property or licensed content. Users cannot reproduce, distribute, alter, or create derivative versions without explicit written authorisation.
9. Data Protection and Privacy
Personal information handling follows our separate Privacy Policy, which details collection, utilisation, and protection practices.
10. Changes to Terms
The company may revise these Terms whenever necessary, with updates becoming effective immediately upon posting.
11. Governing Law
English and Welsh law governs these Terms and any resulting disputes, subject to English court jurisdiction exclusively.
